About Walter Anderocci

After obtaining his Juris Doctorate from Brooklyn Law School, Walter E. Anderocci was admitted to the New York Bar and all the Courts of the State of New York and to various Federal Courts as well. For over thirty (30) years, he has practiced law, specializing in divorce and custody litigation. He has never been the subject of a malpractice action or even a malpractice claim, nor has he ever committed an act of professional misconduct in all the years of practicing law in the most difficult and highly emotionally-charged field of litigation – matrimonial and family law.

Mr. Anderocci is a sole practitioner, and he and his staff will give you their undivided attention. He is the only attorney who will handle your case from beginning to conclusion; the only attorney who will appear for you in Court each time. During this painful and uncertain time in your life, Mr. Anderocci will be your dedicated and aggressive advocate but also an understanding and available counselor and friend.

Practice Areas

  • Divorce
  • As difficult as the divorce process may be, it does not always end with the final decree. There are many circumstances that may arise post-judgment, all of which require an experienced attorney well-versed in negotiations and modification and post-judgment applications.

    A significant source of my clientele is people unsatisfied with prior representation or find a need to modify or enforce prior orders or judgments.

    Perhaps your spouse is in arrears in support payments, or your income level has been reduced drastically and you would seek to reduce your Court-ordered obligations. You may seek to alter child custody due to an ex-spouse’s behavior, a change in circumstances, or yours or your ex-spouse’s need to relocate with your children.

  • Child Support
  • Although controlled by the Child Support Standards Act in New York, which imposes upon the Court a formula to follow when deciding child support, once that award is made, it does not automatically continue forever – many facts and circumstances may change which can allow the court to modify the prior award.

    Child support awards are governed by statute in New York. Awards are based upon the combined parental income and the number of children receiving child support. Children are eligible for child support in New York until the age of 21, by statute, unless they are sooner emancipated, which can come in the form of many changes in the circumstances of the child.

  • Child Custody
  • There is no superior right to the custody of your child based upon your gender or sexual orientation. All custodial decisions are ultimately decided by the Court based upon what the Court determines as the best interests of the children. Although the wishes of children of advanced age are important, those wishes alone do not determine the outcome of custody. Children should never be used as pawns in the dispute between parents, nor should they be enlisted as allies by one parent against the other.
