About Katherine Peluso

Katherine Peluso guides clients through complex multiparty construction litigation, including mediation and arbitration, and access agreement negotiations. Katherine has particular experience handling cases involving adjacent owner disputes, contract disputes, and construction defects. She regularly drafts and negotiates license agreements for both developers and neighbors involving temporary protection and license fees. She has considerable experience organizing and leading mediations, drafting mediation briefs, selecting mediators, and providing cost benefit analyses to clients. She is also experienced in handling appellate motions, construction-related class action settlements, and real property actions and proceedings law (RPAPL 881) cases.

Katherine is also an adjunct professor at the Fordham University School of Law, where she teaches oral advocacy, case strategy, evidence, and witness preparation.

Orchestrated and conducted a multiparty mediation and negotiated a global settlement on behalf of a developer in Brooklyn for its high-end residential property that had experienced extensive gas leaks and required a costly remediation; successfully resolved the dispute with all parties despite significant statute of limitations issues weighing against the developer
Conducted a mediation and negotiated a class action settlement on behalf of a construction manager in New York that was sued in a Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL) action in federal court; resolved the dispute and significantly lowered the client’s potential liability exposure and foreclosed on any future claims by opt-in claimants
Obtained dismissal of two orders on behalf of a developer and builder of a multi-story mixed-use building in Manhattan to show cause seeking to halt construction on the ground that the building did not conform to special zoning rules governing building construction in the area, thereby allowing the project to proceed without interruption
