About Bret McCabe

Bret L. McCabe is a Partner within the firm’s Construction and Litigation practice groups. As such, he is well versed in Construction Law, Transactions and Litigation related to At-Risk CMA’s, Lump Sum Agreements, CM as Agent Contracts, and Subcontractor Agreements.

He has previously served as General Counsel for a number of Construction and Real Estate Development organizations in the past, and also possesses boots on the ground field experience within the New York Demolition and Construction Industry.

In addition to his legal background, his previous roles have included serving as Project Manager, Estimator, Field Superintendent, Construction Site Fire Safety Manager, as well as Vice President of Operations for Safeway Environmental Corporation, LJC Dismantling, and NorthStar Contracting Group, Inc.

As a member of the Construction Law practice group, Mr. McCabe negotiates Construction Management, Owner-Contractor and Subcontractor Agreements for the firm’s Real Estate, General Contractor, Design Professional, Material Vendor and Subcontractor clients.

He also serves as Litigation counsel for a number of complex commercial disputes, including Breach of Contract actions, Landlord-Tenant disputes, Lien Law claims, RPAPL 881 actions, Trespass claims and Labor Law suits.

Additionally, Mr. McCabe performs extensive review of all construction client insurance policies to ensure appropriate coverage levels, and inclusion of all applicable endorsements. He is a licensed Property and Casualty insurance broker and has also served as the Construction Practice Coordinator for Epic Insurance Brokers and Consultants.

Mr. McCabe has been active within the NYC Construction space since 1997, has been interviewed by Business Insurance magazine in regard to the impact that the NYS Labor Law has had on the acquisition and placement of Contractor Insurance Policies; and has also presented a seminar at the 2018 CLM Construction Conference in Chicago discussing the difference between Comparative and Contributory Negligence Jurisdictions and how such nuances affect the drafting and negotiation of Contractual Risk Transfer provisions.
